FAQ
Am I eligible for a tax refund?
You are eligible if you meet all the following criteria:
You were not a U.S. resident at the time of your winnings.
Your casino or gambling earnings were won within the past three years.
You were issued a U.S. I.R.S. Form 1042-S and a Win Slip, from the casino or gaming
facility at the time of your winnings.
You possess the required Canadian government issued identity documentation.

What documents are required to obtain an ITIN number?
The I.R.S requires the following in order to obtain an ITIN number. ORIGINAL DOCUMENTS MUST BE SENT.

Either a valid driver's licence and birth certificate;
             or
A current passport.
These are required so as to be able to notarize your I.D. They will be returned to you by registered mail.

Can I recover my tax withholdings right away?
Because gambling winnings and losses are reported annually, you must wait until January 1st of the following year to apply for your refund.

How much time do I have to claim a refund?
The US tax service (IRS) accepts applications for tax refunds for up to three years following your win.

How long will it take to get my money back?
Applicants who already possess an ITIN number normally receive their refund within 8 – 10 weeks. It usually takes 12 to 18 weeks for those applicants who do not have an ITIN number.

How do I prove my gambling losses?
While you do not have to send documentation to substantiate your losses with your return, documentation may be required if the IRS questions your claim. Therefore, it is wise to keep a record of losses. Acceptable gambling-loss record keeping could include a written log detailing the date of your wagers, the location, amount bet, type of gaming, and wins and losses. You should also retain the losing lottery tickets or bingo cards.

How does Can-Win help to get my tax withholdings back?
We can assist you in obtaining the (US) Taxpayer Identification Number (ITIN) required to make a claim and help you to prepare your non-resident income tax return. After several weeks, you cash your cheque!
